Which companies need a representative under the Data Act?

According to Article 37(11) to (13) of the Data Act, providers without an establishment in the European Union must appoint a representative in the Union if they:

Provide connected products on the Union market

Offer services in the Union that fall within the scope of the Data Act.

The appointed representative serves as a central point of contact for the competent authorities in the EU. He is mandated to cooperate with these authorities and, upon request, to provide them with comprehensive evidence of the measures and precautions taken by the non-EU company to comply with the Data Act.
