The legal framework aims to increase transparency, competition and usability of data. For many companies, this means new rights \u2013 and new obligations.<\/strong><\/p>\n\n\n\n<p>But what does this mean for your business? Who is considered the Data Holder? What data must be provided \u2013 and to whom?<\/p>\n\n\n\n<p>In our series blog posts on the Data Act, we provide practical insights into the new regulation. We start with the basics: terms, roles and initial recommendations for action.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What is the Data Act about?<\/strong><\/h2>\n\n\n\n<p>The Data Act has an ambitious goal: to improve the availability and reuse of data in order to strengthen innovation and competitiveness in the EU. At the same time, new obligations arise for companies \u2013 especially if they offer or use so-called connected products or related services.<\/p>\n\n\n\n<p>The key principle: The User is central. Anyone who uses an IoT product \u2013 whether a business or a consumer \u2013 should also be in control of the data it generates. Users can request to access the data, use it themselves, or have it shared with third parties.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Overview of important roles<\/strong><\/h2>\n\n\n\n<p>To correctly identify your obligations, it&#8217;s important to know the key stakeholders of the Data Act:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Manufacturer<\/strong> \u2013 provides the IoT product<\/li><li><strong>Data<\/strong> <strong>Holder<\/strong> \u2013 has actual control over the data<strong>User<\/strong> \u2013 is entitled to use the connected product (e.g. customer, lessee, operator)<\/li><li><strong>Data<\/strong> <strong>Recipient<\/strong> \u2013 receives the data at the User&#8217;s request<\/li><li><strong>Data<\/strong> <strong>Subject<\/strong> \u2013 insofar as personal data is affected, the GDPR also applies<\/li><\/ul>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"875\" height=\"459\" src=\"https:\/\/planit.legal\/wp-content\/uploads\/2025\/04\/Schaubild-Data-Act-EN.png\" alt=\"\" class=\"wp-image-10910\" srcset=\"https:\/\/planit.legal\/wp-content\/uploads\/2025\/04\/Schaubild-Data-Act-EN.png 875w, https:\/\/planit.legal\/wp-content\/uploads\/2025\/04\/Schaubild-Data-Act-EN-300x157.png 300w, https:\/\/planit.legal\/wp-content\/uploads\/2025\/04\/Schaubild-Data-Act-EN-768x403.png 768w\" sizes=\"auto, (max-width: 875px) 100vw, 875px\" \/><figcaption>Figure: Data Act<\/figcaption><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What are \u201cconnected products\u201d and \u201cproduct data\u201d?<\/strong><\/h2>\n\n\n\n<p>The Data Act does not apply to every product, but specifically to connected products that can generate and transmit product data. Examples are:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Vehicles and machinery<\/li><li>Household and medical products<\/li><li>Agricultural products<\/li><li>Smart home or lifestyle applications<\/li><\/ul>\n\n\n\n<p>Product data is generated by sensors, for example, for temperature, pressure, speed, position or fill level \u2013 regardless of whether the device is actively used or on standby.<\/p>\n\n\n\n<p>The following data is not affected by the Data Act:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Content data (e.g. text or image files)<\/li><li>Data whose value has been created through extensive further processing (investment protection)<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Contractual obligations: What needs to be done now<\/strong><\/h2>\n\n\n\n<p>A central element of the Data Act is the obligation of the Data Holder to contractually secure the use of data:<\/p>\n\n\n\n<p>If you want to use product data from an IoT product for your own purposes, you need the user&#8217;s express consent \u2013 and thus a corresponding contract. Without this, you risk severe fines based on the standards of the GDPR (up to 20 million euros or 4% of global revenue).<\/p>\n\n\n\n<p>Many companies will have to include this point in future purchase, rent or lease contracts. Now is the time to review existing contracts and adapt them if necessary.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>New rights \u2013 new challenges<\/strong><\/h2>\n\n\n\n<p>In the future, users will be able to:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Request access to product data<\/li><li>Request to share data with a third party (data recipient)<\/li><\/ul>\n\n\n\n<p>Data Holder are obliged to comply with this \u2013 provided that there are no interests worthy of protection or legal barriers to prevent it. In practice, clear processes, technical interfaces and legally sound contracts will be essential here.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Data as a business model?<\/strong><\/h2>\n\n\n\n<p>The Data Act not only creates obligations \u2013 it also opens up potential: Companies that act as data recipients or provide platforms for data exchange could unlock entirely new data-driven business models. Provided, that the legal requirements are met.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Our advice: act early<\/strong><\/h2>\n\n\n\n<p>There is still uncertainty regarding many details \u2013 not least because the case law interpreting the Data Act is yet to emerge.
